Former Anthrax guitarist Dan Spitz is no longer facing domestic violence charges after he was arrested on Christmas Day.
The musician was detained in connection with an alleged violent altercation involving his wife at their Florida home – but Candi Spitz has said all along it was a “misunderstanding”.
She said at the time: “We were separated for a week last year, and Christmas Eve was the first anniversary. The stress level at home has been astronomical. Our children are both autistic and Dan may have early onset Parkinson’s Disease. We were all drinking wine, and he just snapped.”
But, despite claims of his attempting to choke her, she insisted the nearest thing to a violent incident was when he pushed past her and she bruised her shoulder. “He’s five feet tall and a hundred pounds all wet,” she said, “And I kick-box. He could never harm me if he tried. My mom should never have called 911.”
Now the Palm Beach County State Attorney has been persuaded there were “discrepancies” on the incident report, and no further action should be taken.
Spitz, who returned to music with his band Red Lamb in 2012, last year described his home life as “hell” as he and Candi worked to bring up their autistic twins.
